Lawyer argues publicity around murder case precludes fair trial

The lawyer for Ashley Haley, the co-accused in the murder of Jennifer Horne, is attempting to alter how the first-degree murder trial will go ahead.
Haley’s lawyer, Kevin Burke, says with all the publicity surrounding the case they’re worried about getting a fair trial.
“It would be preferable given the legal issues involved to have this argued before a judge alone or in the alternative have it moved out of the Halifax area,” says Burke.
Burke has suggested Kentville as a location. Justice Richard Coughlan adjourned the proceedings until Monday.
Haley and Desmond Maguire are each charged in the December 2007 death of Jennifer Horne.
Horne’s body was found New Year’s Eve 2007 in the apartment the two accused shared in Dartmouth. Haley and Maguire were charged with murder the next day.
Jeannie Rokosh speaks for the victim’s family.
“It would make things extremely difficult,” says Rokosh about moving the case to an alternate location. “But in the end is what we’re not opposed is getting the trial happening and get it moving and get the whole thing over.”
The murder trial is scheduled to start June 7.
