Judge reserves decision in case of N.S. man charged in fatal crash

A judge has reserved his decision until July 10 in the case of a Nova Scotia man charged following a 2011 crash that claimed the lives of two teenagers.
The trial for 32-year-old William Fogarty wrapped up today in Nova Scotia Supreme Court in Antigonish. The Antigonish man faces two counts each of dangerous driving causing death and impaired driving by drugs causing death. Seventeen-year-old Nicholas Landry and 16-year-old Kory Mattie died in the crash on Highway 4 in Tracadie.
Crown attorney Darlene Oko told court Fogarty’s admission that he voluntarily took drugs and the manner in which witnesses say he drove his vehicle provide overwhelming evidence his driving posed a public danger.
Defence lawyer Luke Craggs says his client was driving aggressively but not dangerously, and he asked the judge to consider the possibility the car driven by the victims was travelling too fast, based on the 16-metre skid mark at the accident scene.
