Incest charges against Antigonish-area man stayed

An Antigonish-area man accused of fathering his daughter’s child is no longer headed to trial on a charge of incest.
The Chronicle Herald reports the man is accused of incest with his daughter between December 1998 and August 1999.
The victim first went to police in October, 2000 — about a year after her child was born. She went to police a second time before her father was arrested in April 2003. He wasn’t charged with incest until August 2004.
Several delays in getting to trial were caused by new evidence, waiting for d-n-a testing, lawyers and a judge leaving the case for different reasons, and the accused’s medical conditions.
The man is now a paraplegic, with no control of his bowels or bladder. He is fed through a feeding tube.
Nova Scotia Supreme Court stayed the incest charge.
This case could have an impact on charges against a man accused of sexually abusing children. Ernest Fenwick MacIntosh is accused of molesting six boys, in the 1970s. His lawyer says those charges should be also be stayed because of delays in that case.
