Home for Colored Children settlement moves forward

The deadline has now passed for former residents of the Nova Scotia Home for Colored Children to opt out of a class action settlement with the province.

Mike Dull with Wagners law firm says the settlement process can now move forward.

“That shows to us what we suspected all along — that class members, the former residents, are generally pleased with the settlement,” said Dull.

About 250 former residents at the orphanage have joined the class action, and will share in a $29 million settlement with the province over allegations of abuse at the facility.

If six or more claimants had opted out of the settlement, the province would have had the option of terminating the agreement.

Dull said with the deadline past, “the work really starts.”

“It’s going to be a long, involved process, comprised of many professionals, to see this through to a final, final resolution. That will take place some time next year, we suspect,” he said.

The claims will now be handed over to an adjudicator for disbursement of the money.
