Co-accused in Jennifer Horne murder seeks trial by judge alone

A Dartmouth woman charged in a grisly murder is asking to have her case heard by a judge only.

Ashley Haley is charged along with her boyfriend in the December 2007 killing of Jennifer Horne.

If she doesn’t get that wish the Herald reports her lawyer wants a change of venue, with a jury made up of people from outside HRM.

Suspects accused of murder automatically go to trial with a judge and jury. If they want a judge alone or a change of venue the defence lawyer  has to prove that not doing so would harm their client’s chances of a fair trial.

Haley’s lawyer says he’s concerned that extensive media coverage of the case may have tainted the opinions of potential jury members.

Haley and her common-law husband, Desmond Maguire, were arrested after Horne’s body was found wrapped in a carpet in the closet of a Dartmouth apartment.

Macguire’s lawyer will also seek the same changes to his trial.
